This Online Privacy Policy (“Privacy Policy”) applies to the information about you that OhGoody LLC (“OhGoody”, “we”, or “us”) may obtain when you visit OhGoody.com (the “Site”) and interact with the services that we may make available through the Site (collectively, the “Services”) This Privacy Policy describes our privacy practices for the Services, including the choices you have and the ways OhGoody safeguards information about you. Please note, this Privacy Policy does not apply to the practices of third parties (including other users who sell using the Services) who may also collect or receive information in connection with your use of the Services.

By using the Services, you acknowledge and accept this Privacy Policy and consent to the collection and use of your personal information as described in this Privacy Policy. Please also review the Terms of Use, which govern your use of the Site, the Services and any content you submit to the Site.

1. Information OhGoody Collects or Receives

You acknowledge that while using the Services, OhGoody may collect personal information in a number of different ways.

a. Information You provide.

We, and our service providers, may obtain personal information that you provide to us directly, for example, data you submit when you complete contact forms, sign up for marketing or informational newsletters, create an account with OhGoody (“Account”), purchase products listed by other users, or otherwise interact with the Services. This information could include your email address, name, billing and shipping address, country, birth date, phone number, and payment processing information.

If you choose to use OhGoody’s Services to sell products to other users through the Services (“Vendors”), we may require additional information, including bank account information, identification information (identification ID, tax, ID or social security number), a photograph, credit card information, or other means of verifying your identity to provide the Services to you (including to set up your vendor Account) and comply with applicable laws.

Any information submitted through the Account application process/the registration process will not be displayed publicly and will only be used internally by OhGoody, unless otherwise specified

b. Information We Collect Automatically.

In addition to any personal information or other information that you choose to submit to the Site, we and our service providers (including content and analytics providers and advertising companies) may use a variety of tracking technologies that automatically or passively collect certain information whenever you visit the Site or interact with certain features of the Service or one of our advertisements or other content elsewhere online. This type of usage information may include the browser you are using to access the Site, your IP address or other unique device identifier, geolocation, search terms, your use of the Service (including clicks, movement, scrolling, and keystroke activity), the URL that referred you to the Site, all of the areas within our Site that you visit, anonymous traffic data, and the time of the visit.

Non-precise location information.

OhGoody may use GPS (global positioning systems) software, geo-filtering, and other location-aware information technologies to collect information about your non-precise location for purposes such as verifying your location and delivering or restricting content based on your location. Our Site may be personalized based on various information we may have about you to provide you with more location-relevant content.

Information from Vendors.

OhGoody may receive/request information from Vendors about you. This information can include customer service interactions, payments information, shipping information and other information shared in OhGoody’s public spaces.

Advertising and Marketing.

OhGoody may use third-party technology to collect and use information in connection with interest-based advertising. These third-party advertising and marketing technology companies may use, store, or access cookies and other storage technologies to collect or receive information from the Site and elsewhere on the Internet and use that information to provide advertising services to us, including interest-based advertising or advertisements targeted to your interests.

Analytics Information.

OhGoody may use third-party analytics software and services, including Google and Facebook to help us understand and analyze how visitors use the Site and to serve advertisements on our behalf across the Internet. This software records things such as, but not limited to, aggregate usage, errors, debugging information and performance data. OhGoody does not link information stored within OhGoody’s analytics software to any personal information You submit to Your Account.

OhGoody may also obtain information about you from other sources, including service providers and third-party information that we collect. Notwithstanding anything to the contrary, except to the extent such data combined by or on behalf of OhGoody with OhGoody-collected information, this Privacy Policy is not intended to limit OhGoody’s activities regarding such third-party-sourced, or non-Site-sourced, information, and such data will only be treated as OhGoody-collected information to the extent it is combined with OhGoody-collected information. OhGoody is not responsible or liable for the accuracy of the information provided by third parties or for third-party policies or practices.

2. How We Use this Information

When OhGoody uses your information, we do so for the following purposes:

  • Providing and Improving the Site and Services. OhGoody uses your information to provide the Services OhGoody offers, including processing your orders and payments. We may also use your information to improve the Site and the Services. As an essential part of the Services OhGoody offers, OhGoody has a legitimate interest in customizing your on-Site experience to help you find items related to your purchases, including using this information to help Buyers and Vendors find the best and most efficient ways to market, sell and purchase products offered on the Site.
  • Keeping OhGoody’s Services and Site safe and secure. OhGoody uses your information for safety and security purposes. this can include occasionally sharing your information with a third-party to ensure protection for Buyers and Vendors from harm to individuals or property, defending legal rights and preventing damage, the prevention of criminal activity and protecting OhGoody’s systems and the systems of OhGoody’s partners. These protections include but are not limited to, protecting the Service and the community against spam, harassment, intellectual property infringement, crime and any kind of security risk. OhGoody also uses your information to help authenticate billing and payments, identification purposes, general research and aggregate reporting in the interest of pursuing security for you.
  • Legality and Safety reasons. OhGoody may use your personal information to investigate claims and/or legal actions, violations of our Terms of Use and other OhGoody policies and procedures, and compliance with relevant applicable laws and legal process.
  • Site Customization. OhGoody may use your browsing information to better recommend products and services You may be interested in. As this is an essential part of OhGoody’s Services, OhGoody has a legitimate interest in customizing your on-Site experience to help you discover Vendors and products that you would like to be exposed to and to help these Vendors best market their products and services.
  • Marketing & Electronic Communications. OhGoody relies on OhGoody’s legitimate interests to send you marketing messages and other electronic communications (where permitted independent of consent) and for OhGoody’s on-Site advertising programs.
3. Disclosure of Your Personal Information

If you are a Buyer, we may share the information we collect or receive from you with Vendors to enable Vendors to operate their business (e.g., to allow them to complete a transaction, screen orders for fraud and risk, fulfill orders, and contact you with new products or offers).

We may share information we collect about you with our subsidiaries and affiliates. OhGoody does not share your personal information with third parties outside of OhGoody unless one of the following circumstances applies:

  • With your consent. We will share your personal information with companies, organizations, or individuals outside of OhGoody when we have your consent to do so.
  • For external processing. We may use service providers to help us operate our business and the Site, or administer activities on our behalf, such as accepting and fulfilling your order, sending emails, serving advertisements, order fulfillment, sweepstake administration, website maintenance, and customer service. For advertising purposes, we may share with service providers your information, including your personal information (such as your email address) and information we collect automatically.
  • For Legal Reasons. We will share your personal information with third parties (i) as permitted by law; (ii) where we determine that disclosure of specific information is necessary to comply with the request of a law enforcement or regulatory agency or other legal process; or (iii) to enforce our policies, or to protect legal rights, property, or safety.
  • Business Transfers. If we establish a new related entity, are acquired by or merged with another organization, or if substantially all of our assets are transferred to another organization, personal information about you may be transferred as a business asset.   • Aggregated Information. OhGoody may use any aggregated information to conduct internal analytics services with OhGoody’s affiliated businesses, but any such information will be de-personalized and non-identifying.
4. Information of Minors

The Services are not intended for children under the age of thirteen (13) and we do not knowingly collect personal information from individuals under the age of 13. Children under the age of 13 are not permitted to use the Services. If we become aware that we have obtained personal information from a child under age 13 we will delete such information in accordance with applicable law.

5. Community

You acknowledge that OhGoody offers several features for Buyers and Vendors to participate in public and semi-public spaces. When you leave reviews, list items, or otherwise post information, use good judgement and be aware that you are sharing information in a public space. This information can be collected or used by others and may result in you receiving unsolicited messages. OhGoody engages with certain third parties to assist in providing these community spaces to you and as such may share some information from your Account that is publicly available (e.g., what you post or your username). Things you post may remain as public information, even after you have terminated your Account. You are solely responsible for any personal information you choose to post in community spaces through OhGoody’s Services.

6. Transfers

If you are visiting the Site from outside the United States, please be aware that OhGoody is based in the U.S. and the information we obtain through the Services will be transferred to, processed, and stored on our servers in the United States. The data protection laws and regulations applicable to your personal data transferred to the United States may be different from the laws in your country of residence.

OhGoody follows the generally accepted industry standards to protect any personal information submitted to OhGoody, both during transmission and after it is received. No method of transmission over the internet is completely secure so OhGoody cannot guarantee the absolute security of your personal information.

9. Your Rights

a. Accessing, Reviewing & Changing Your Personal Information

Buyers and Vendors can review and change certain personal information (e.g., name, address, telephone number, email address, and payment information) at any time by accessing their Account on the Site. 

b. Email and Electronic Communications

OhGoody may contact you through tools available through the Service or via email. These messages could include marketing, transaction information, advocacy information and service update messages. Every Account must keep a valid email address on file. OhGoody may also try to contact you via phone to provide support, for service-related purposes (including communications relating to your Account or use of the Services, such as administrative and service announcements, security issues, transaction or product updates) or if you request that OhGoody contact you. You understand and agree such messages are service-related and necessary.

When you register for an OhGoody newsletter or provide OhGoody with your email address or phone number (e.g., for a guest checkout purchase), You receive notice of and agree (in some jurisdictions and situations, by an additional unambiguous consent) to receive marketing emails and messages from OhGoody. You can opt out of receiving these marketing communications via the unsubscribe link included in such communications or your Account settings. You can unsubscribe at any time from the marketing messages and emails. Unsubscribing from these messages may take a few days to take effect. With your consent (which you may withdraw at any time), OhGoody may also wish to send you messages related to our various businesses and affiliates, which may include co-promotions with or about other parties that OhGoody thinks you may find interest in. Preferences Regarding Email and electronic communications. You may control the types of communications from OhGoody in your Account settings. Some messages are required, others are not. You can control which optional messages you receive in your Account settings.

10. Third Parties

Occasionally we provide links on our Site to other websites we think you will enjoy. These websites operate independently of OhGoody and have established their own privacy and security policies. OhGoody does not have any control over, and is not responsible for, these websites’ privacy practices. For the best online experience, we strongly encourage you to review these policies on any website you visit.

When you visit or interact with a Vendor’s storefront or make a purchase from a Vendor through the Services, the Vendor may also have access to some of your personal information including your name and shipping address. As a result, the Vendors may have their own privacy and security policies. If you have questions about how a Vendor processes your personal information, you should contact the Vendor or visit their privacy policies. 

11. Policy Changes

OhGoody may amend this Privacy Policy at OhGoody’s sole discretion. If OhGoody makes any changes, OhGoody will notify you via email or a notice on the Site and revise the date at the top of this Privacy Policy. Your continued use of the Services after updates to this Privacy Policy will constitute your acceptance of the change.
